Capri by Fraser, Leipzig — Instagram Prize Draw Terms & Conditions

By entering this prize draw, participants agree to be bound by these Terms and Conditions.

1. The Promoter

The promoter of this prize draw is Frasers Hospitality Leipzig GmbH, with its registered office at Brühl 76, 04109 Leipzig, registered at the commercial registere at the local court of Leipzig under HRB 33616, and reachable at 0049 341 92881 800 and reservations.leipzig@capribyfraser.com.

(hereafter referred to as "the Promoter"). The Promoter is solely responsible for the conduct and administration of this prize draw.

2. Eligibility

· The prize draw is open to individuals aged 18 years or over at the time of entry.

· Employees of the Promoter, their families, agents, or anyone professionally connected with this promotion are excluded from entering.

· A valid Instagram account is required to enter. Entry is free of charge, no purchase is necessary, and no payment, stake, or fee of any kind is required to participate or to increase a participant's chance of winning.

3. How to Enter

These Terms and Conditions constitute the complete participation conditions for this prize draw and are made available to entrants via the link in the promotional Instagram post or bio before entry. To enter the prize draw, entrants must complete the following steps on Instagram before the closing date:

1. Follow the official @caprileipzig Instagram account.

2. Like the official promotional giveaway Reel/post.

3. Tag a friend in the comment section of the promotional Reel/post.

· There is only one entry per person permitted.

4. Promotional Period

· The prize draw opens on 04 September 2026 (the "Starting Date") and closes at 23:59 CET/CEST on 10 September 2026 (the "Closing Date")

· Entries received after this time will not be accepted.

5. The Prize

· The prize consists of one (1) hotel voucher valid for a two (2) night stay for two (2) guests (sharing one room) at Capri by Fraser, Leipzig.

· The prize includes daily breakfast for both guests.

· Prize Specific Conditions:

o Advance Booking: Reservations are strictly required and are subject to availability.

o Validity: The voucher is valid for exactly one (1) year from the date of issue and must be used before the stated expiry date. No extensions will be granted.

o Overage Costs: Any charges or amounts spent during the stay exceeding the direct prize value (e.g., additional food & beverage, parking, laundry, etc.) are the responsibility of the guest and must be paid in cash or by credit card at check-out.

o Non-Refundable: The prize is non-refundable, non-transferable, and cannot be redeemed for cash, credit, or alternative services.

6. Winner Selection and Notification

· One (1) winner will be selected at random from all eligible entries using a random generator tool.

· The draw will take place within 3 working days of the Closing Date.

· The winner will be notified via Direct Message (DM) on Instagram from the official verified account - @caprileipzig.

· Claim Period: The winner must claim their prize by responding to the DM within 14 days of notification. If a winner does not respond within 14 days, the Promoter reserves the right to forfeit the prize and conduct a redraw to select a runner-up winner.

7. Data Protection & GDPR Compliance

· The data controller for the purposes of this prize draw is the Promoter identified in Section 1 above. By entering the prize draw, you acknowledge that the Promoter will collect and process your Instagram handle and (if you win) your full name, email address, and physical address solely for the purpose of administering this promotion and delivering the prize. The legal basis for this processing is the Promoter's legitimate interest in operating the prize draw and, where you are selected as a winner, the performance of the resulting contractual obligation to deliver the prize (Article 6(1)(b) and (f) GDPR).

· All personal data will be processed in accordance with the General Data Protection Regulation (GDPR) and our Privacy Policy.

· Your personal details will not be shared with third parties or used for general marketing purposes unless you have given explicit consent to do so. Personal data collected for this prize draw will be retained only for as long as necessary to administer the promotion and deliver the prize, and will be deleted or anonymised thereafter unless a longer retention period is required by law. You have the right to request access to, rectification or erasure of, and restriction of or objection to the processing of your personal data, as well as the right to data portability, by contacting the Promoter using the details set out in Section 1. You also have the right to lodge a complaint with a competent data protection supervisory authority, including the German Federal Commissioner for Data Protection and Freedom of Information (BfDI) or the competent state data protection authority.

8. Limitation of Liability & General Rules

· The Promoter reserves the right to cancel, suspend, or amend the prize draw or these terms where it becomes necessary to do so due to circumstances beyond its reasonable control.

· This promotion is in no way sponsored, endorsed, administered by, or associated with Instagram/Meta. By entering, participants agree to a complete release of Instagram from any liability in connection with this promotion.

· Nothing in these Terms and Conditions excludes or limits the Promoter's liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable German law, including liability for intentional acts or gross negligence.

· Should any provision of these Terms and Conditions be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that comes as close as possible to the economic intent of the original provision.

· These Terms and Conditions shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without prejudice to any mandatory consumer protection provisions of the country in which a participant is habitually resident, which continue to apply where required by applicable law. Any disputes shall be subject to the exclusive jurisdiction of the competent

courts of Leipzig, Germany, save where mandatory consumer protection rules provide for a different venue.
